绿色发展导向下压覆矿产资源管理机制优化研究:基于新《矿产资源法》视角的思考

    Research on the optimization of management mechanism of overlying mineral resources under the guidance of green development: reflections based on the perspective of the new Mineral Resources Law

    • 摘要: 2024年新修订的《矿产资源法》将加强矿产资源和生态环境保护、推动矿业高质量发展、保障国家矿产资源安全纳入法定范围。从法律层面进一步明确压覆战略性矿产资源审批、战略性矿产资源特殊保护等有关制度,将压覆审批的功能定位提升至国家资源安全战略高度。基于此,为统筹战略性矿产资源保护与重大建设项目要素保障的关系,协调矿产资源勘查开发空间和重大工程建设落地、强化资源保护和合理利用,通过制度梳理与案例分析,回顾了建设项目压覆矿产资源管理历程,重点梳理了“源头预防”的规划嵌入,以及压覆矿产资源审批对象、时限、程序、建设项目类型及相关工作有效衔接等方面的主要内容。深入剖析了压覆矿产资源管理改革变化及当前在并联审批、补偿协议签订、差异化管理、跟踪监管机制与价值核算等方面存在的困境。同时探究新《矿产资源法》视域下的生态约束与弹性平衡、“多审合一”的改革实践探索,总结地方实例,提炼可复制推广的改革经验。最后,从简化审批流程、优化补偿管理、区别对待原则、细化责任落实、强化评估机制五个方面提出有针对性的意见建议,为新时期压覆矿产资源管理提供有益的实践参考。

       

      Abstract: The newly revised Mineral Resources Law of 2024 incorporates into its statutory scope the strengthening of mineral resource and ecological environment protection, the promotion of high-quality development of the mining industry, and the safeguarding of national mineral resource security. From the legislative level, it further specifies the institutional arrangements concerning the approval of overlying strategic mineral resources and the special protection of strategic mineral resources, thereby elevating the functional positioning of overlying approval to the strategic height of national resource security. Against this backdrop, in order to coordinate the relationship between strategic mineral resource protection and factor assurance for major construction projects, harmonize the spatial configuration of mineral resource exploration and development with the implementation of major engineering construction, and strengthen resource protection and rational utilization, this study reviews the management evolution of mineral resource overlying by construction projects through institutional review and case analysis, with a focus on the key aspects of “planning embedding for source prevention”, the approval objects, timeframes, procedures, and project categories of overlying approval, as well as the effective coordination of related work. The paper provides an in-depth analysis of the reform transitions in mineral resource overlying management and the current dilemmas in concurrent approval, conclusion of compensation agreements, differentiated management, tracking and supervision mechanisms, and value accounting. Furthermore, it explores the ecological constraints and flexible balance under the framework of the new Mineral Resources Law, examines the reform practice of “consolidated multi-approval”, summarizes local cases, and distills replicable and generalizable reform experiences. Finally, targeted recommendations are proposed from five dimensions—streamlining approval procedures, optimizing compensation management, applying the principle of differentiated treatment, refining accountability, and strengthening evaluation mechanisms—providing useful practical references for mineral resource overlying management in the new era.
