页岩气开发中环境影响评价法律机制的国外镜鉴

作为清洁、高效的非常规天然气,页岩气的开发不仅推动我国经济朝着绿色高质量方向发展,而且能够促进调整能源供需结构,缓和能源供应短缺情况。现有的环境影响评价法律机制无法满足页岩气大规模开发的需求。为了解决这一问题,本文概述了页岩气开发造成的负面影响,主要表现为水资源消耗和污染、大气污染、土壤污染、地质灾害、噪声污染等。采用文献研究法、比较研究法、定性分析法,在借鉴国外先进机制的同时,结合现实情况,从环境影响评价政策、介入时机、评价内容和深度、分类分级管理和公众参与等五个方面深入分析了我国页岩气环境影响评价的现状,针对不足提出相关建议,以完善我国页岩气环境影响评价法律机制。建议具体包括:一是完善页岩气开发法律法规和标准规范;二是组织开展战略环境影响评价或规划环境影响评价;三是加强页岩气开发环境影响评价管理;四是强化公众参与程度。
Abstract:Shale gas is a kind of clean and efficient unconventional gas.Its development not only promotes the development of China's economy in a green and high-quality direction, but also can adjust the structure of energy supply and demand and alleviate the shortage of energy supply.The existing legal mechanism for environmental impact assessment cannot meet the needs of large-scale shale gas development.In order to solve the problem, this paper summarizes the negative environmental impacts brought about by shale gas development, which are mainly manifested in water consumption, water pollution, air pollution, geological disaster and environmental destruction, etc.This paper uses literature research, comparative research, qualitative analysis.Therefore, while drawing lessons from foreign advanced mechanisms, combining the reality of our country, this paper deeply analyzes the current situation and shortages of Chinese shale gas environmental impact assessment from five aspects:environmental impact assessment policies, intervention time, assessment content and depth, graded and classified administration, and public participation.In order to perfect our country's shale gas legal mechanism for environment impact assessment, the relevant suggestions will be put forward in response to the deficiencies.First of all, China should perfect its laws, regulations and standards for shale gas development.Secondly, China should organize strategic environmental impact assessment or planning environmental impact assessment.Thirdly, China should strengthen environmental impact assessment management of shale gas development.Finally, China should improve the degree of public participation.
