人与自然和谐共生现代化视阈下矿区生态修复制度优化:以《矿产资源法》修订为契机

    Optimization of ecological restoration system in mining area from the perspective of harmonious coexistence between man and nature: taking the revision of the Mineral Resources Law as an opportunity

    • 摘要: 矿区生态修复是贯彻落实国家生态文明建设要求的重要举措之一,对于提升区域生态系统质量和稳定性、维护国家及区域生态安全具有重大推动作用。但在当前人与自然和谐共生的现代化背景之下,矿区生态修复还面临资金短缺、市场机制不健全等现实难题。造成这种现象的原因,与法律制度的相对滞后性不无关联。对此,本文建议借《矿产资源法》修订之际,以人与自然和谐共生理论为指导,加强顶层设计,进一步优化矿区生态修复制度立法。在宏观思路方面,坚持源头治理、自然恢复、价值转化、强化责任等基本原则;在微观措施方面,修复理念践行系统修复模式、修复方案突出将资源变资产的市场运行机制、修复方式强化自然恢复、修复资金重在盘活来源、修复保障引入生态信用制度等,综合推动实现矿区生态保护与经济协同发展。

       

      Abstract: Ecological restoration in mining areas is one of the important measures to implement the requirements of national ecological civilization construction, which plays a significant role in promoting the quality and stability of regional ecosystems and maintaining national and regional ecological security. However, under the modern background of harmonious coexistence between man and nature, the ecological restoration in mining areas still faces some practical problems such as shortage of funds and imperfect market mechanism. The reason for this phenomenon is related to the relative lag of the legal system. In this regard, this paper suggests to strengthen the top-level design, and further optimize the legislation of the ecological restoration system in mining areas, taking the revision of the Mineral Resources Law, guided by the theory of harmonious coexistence between man and nature. In terms of macro-thinking, we should adhere to the basic principles of source management, natural recovery, market transformation, and strengthening responsibility; on the other hand, in terms of micro-measures, the restoration concept implements the systematic restoration model, and the restoration plan highlights the market operation mechanism of converting resources into assets, the restoration method strengthening natural restoration, the restoration fund focusing on the clear source, and the restoration guaranteeing is introduced into the ecological credit system, and so on, to promote the coordinated development of ecological protection and economy in the mining area.
