战略性矿产资源储备法律制度完善研究

    Research on the improvement of the legal system for strategic mineral resource reserves

    • 摘要: 在全球气候治理与地缘政治风险交织的时代背景下,战略性矿产资源已由传统工业原料升格为关涉国家安全、经济主权与技术竞争力的核心战略资产。我国战略性矿产资源储备制度在面对国际规则倒逼、资源供应链重构及新能源转型等多重压力时,暴露出立法滞后、主体权利义务不清、制度碎片化及国际法应对能力不足等深层次法治困境。本文立足自然资源永久主权理论与公共物品理论,从国家资源安全与可持续发展双重目标出发,系统剖析战略性矿产资源储备法律制度的现状与症结。通过对美国《国防生产法》、欧盟《关键原材料法案》及日本《稀有金属保障法》等域外经验的比较研究,提出应构建以“战略性矿产资源储备法”为核心,统筹“产品—产能—产地”储备类型、落实绿色储备标准、明确多元储备主体权责、强化预防性监管与问责机制的层级化、协同性法律体系。同时,建议以全球公共资源治理理念为导向,将储备制度嵌入国际法框架,提升我国在全球资源治理中的规则塑造能力。本文旨在通过法理廓清与制度创新,推动构建具有韧性、可持续性与法治化特征的战略性矿产资源储备体系,为我国资源治理现代化与生态文明法治建设提供理论支持与制度保障。

       

      Abstract: In the context of the interweaving of global climate governance and geopolitical risks, strategic mineral resources have been upgraded from traditional industrial raw materials to core strategic assets related to national security, economic sovereignty, and technological competitiveness. When faced with multiple pressures such as international rules, resource supply chain restructuring, and new energy transformation, China’s strategic mineral resource reserve system has exposed deep-seated legal dilemmas such as legislative lag, unclear rights and obligations of entities, fragmented systems, and insufficient international legal response capabilities. This paper is based on the theories of permanent sovereignty over natural resources and public goods. Starting from the dual goals of national resource security and sustainable development, it systematically analyzes the current situation and crux of the legal system for strategic mineral resource reserves. Through comparative research on foreign experiences such as the US Defense Production Act, the EU’s Critical Raw Materials Act, and Japan’s Rare Metals Protection Act, it is proposed to establish a hierarchical and collaborative legal system centered on the Strategic Mineral Resources Reserve Act, which coordinates the types of “product production capacity origin” reserves, implements green reserve standards, clarifies the rights and responsibilities of multiple reserve entities, strengthens preventive supervision and accountability mechanisms. At the same time, it is recommended to be guided by the concept of global public resource governance, embed the reserve system into the international legal framework, and enhance China’s ability to shape rules in global resource governance. This paper aims to promote the construction of a strategic mineral resource reserve system with resilience, sustainability, and rule of law characteristics through legal clarification and institutional innovation, providing theoretical support and institutional guarantees for the modernization of resource governance and the construction of ecological civilization rule of law in China.
