Abstract: Administrative recuperation,a liability for compensation different from administrative compensation assumed by the government,plays a very important role in the administration.Although administrative recuperation has been embodied in administrative statutes in different services,the written basic theories,the criteria and procedures of recuperation are not yet made in the legislation.Based on a brief review of the developmental histrory of administrative recuperation and an analysis of the status quo in the legislation of the same,this paper further advances the proposals for the legislation of administrative recuperation.
