Abstract: Through analyzing the government regulation of mining rights trading, especially mining rights subjects and mining rights transfer conditions, the paper came to the conclusion that the regulation might not achieve its objectives, but increased transaction costs for mining rights, which was not conducive to the prosperity of mining rights market. Based on these, the paper suggested that we should separate the application, acquisition and transfer of mining rights from its execution, and that government only regulate the latter and deregulate the former.
