Abstract:
This paper introduces that the transfer of foreign minerals rights usually follows two mechanisms: consultation and non-consultation. Transfer principles are: first-come, first obtain; first-come, first to be considered; the government chooses the transferee of minerals rights by using administrative discretional power; the way of public invitation of bidding and auction. The ways of transfer include application of granting, agreement granting, bid granting, auction granting and management on a commission basis. It goes on to looking at that different countries adopt different way of transfer, transfer principle and transfer conditions according to their national conditions. As we know, even the same form, it will be given different content in different countries. This paper offers that we should use the experiences of other countries in choosing the effect factors and granting conditions of the way of transfer.
