Abstract: The management of land use for the mining in China is disordered,which works against mineral resources and land protection and rational development and utilization.This paper firstly analyzes the characteristics and problems of relevant institution of land use for the mining in China,and then based on the international experiences,puts forward the principles to improve,namely,correctly handling the relations between mineral resources planning and land use planning,the leasing and transfer of mining rights and land use rights should take place simultaneously,correctly handling the relations between mining rights and land use rights on distinguishing different phases of mineral prospecting and exploitation and types of minerals.At last,the paper gives corresponding recommendations,strengthening the management of land use for mining,to innovate the ways of acquisition of land use for mining,setting up the transfer system for free land allocation for mining,and strengthening the institutions for neighborhood relations of mineral rights.
