Abstract: The transfer of mining rights is an important part of mining laws and regulations.Property law was carried out in 2007, confirming the usufructuary rights of mining rights.With the prosperous development of the socialist market economy, the Mineral Resources Law and relevant laws were acted in planned economy period, which could not regulate the behave of mining rights transfer according to the property rights theory for many years.The economic value of mining rights cannot be fully realized.The construction of the mining rights transfer system are proposed to confirm the concept of mining rights, expanding the free transfer ways and limitations, resetting the elements of administrative license and improving the registrations on the basis of property theory.
