    我国矿产资源刑事保护立法探析

    Study on the criminal protection legislation of mineral resources in China

    • 摘要: 法律、行政法规、部门规章以及规范性文件中关于惩治矿产资源犯罪的规定是维护矿产资源开发利用秩序的重要保障,但现有的矿产资源刑事法律规定还存在前提要件规定苛刻、结果要件规定模糊、刑罚设置不合理以及衔接不一致的问题。因此需要在新修订的《中华人民共和国矿产资源法》明确规定非法采矿罪、破坏性采矿罪的基础上,进一步完善非法采矿罪和破坏性采矿罪的规定。

       

      Abstract: The provisions on punishing mineral resources crimes in laws, administrative regulations, departmental rules and normative documents are an important guarantee to maintain the order of mineral resources development and utilization. However, the existing criminal laws and regulations on mineral resources still have the following problems: harsh prerequisites, vague results, unreasonable penalty settings and inconsistent connection. Therefore, it is necessary to further improve the provisions of the crime of illegal mining and the crime of destructive mining on the basis of the newly revised mining law, which clearly stipulates the crime of illegal mining and the crime of destructive mining.
