Study on the criminal protection legislation of mineral resources in China

The provisions on punishing mineral resources crimes in laws, administrative regulations, departmental rules and normative documents are an important guarantee to maintain the order of mineral resources development and utilization. However, the existing criminal laws and regulations on mineral resources still have the following problems: harsh prerequisites, vague results, unreasonable penalty settings and inconsistent connection. Therefore, it is necessary to further improve the provisions of the crime of illegal mining and the crime of destructive mining on the basis of the newly revised mining law, which clearly stipulates the crime of illegal mining and the crime of destructive mining.
