OWNERSHIP OF MINERAL RESOURCES OF OUR COUNTRY

    • It is provided in Constitution of the People's Republic of China and Law of the People's Republic of China on Mineral Resources that mineral resources in China are owned by the state. As we all know, most mineral resources are deeply buried underground,so they are unclear before they are proved and they can not become the object of jus rerem at this stage, they can not be the object of state ownership either.Only after some mineral resource is proved to be of certain reserves in a block then it can be the object of jus rerem and of state ownership. Thus the state ownership of mineral resources is more a jus rerem principle than a jus rerem institution.Furthermore, ways of the state to exercise its ownership on mineral resources shall be more various.
